Service Nature

Website design and development services are custom, project-based services. Each project is tailored to your specific requirements and created according to agreed-upon specifications outlined in individual service agreements.

Because our services are custom-made and project-specific, they differ from standard retail products. This policy explains how returns, refunds, and cancellations are handled for our services.

Project Agreements

All projects are governed by separate written service agreements that outline deliverables, timelines, payment terms, revision policies, and cancellation procedures. These agreements are established before work begins and must be signed by both parties.

The terms of your specific project agreement take precedence over this general policy. Please refer to your project agreement for specific terms regarding your project.

Australian Consumer Law Rights

Under Australian Consumer Law, you have certain rights that cannot be excluded, including guarantees that services will be:

  • Provided with due care and skill
  • Fit for the purpose you made known to us
  • Delivered within a reasonable time (if no time was specified)
  • Provided in accordance with any description or sample we provided

If we fail to meet these guarantees, you may be entitled to remedies including repair, replacement, refund, or compensation for damages.

Revisions and Changes

We work closely with clients throughout the project to ensure satisfaction. Revisions and changes are handled according to the terms specified in your project agreement, which typically includes a certain number of revision rounds.

We strive to deliver work that meets your expectations and will work with you to address concerns during the project timeline. It is important to communicate any issues or desired changes as early as possible in the project.

Additional revisions beyond those included in your agreement may incur additional charges, which will be discussed and agreed upon before work commences.

Refund Policy

Refunds are considered on a case-by-case basis and depend on the specific circumstances, the stage of the project, and the terms of your project agreement.

Completed Work: Generally, refunds are not available for completed work or work that has been delivered and accepted by you. Once you have accepted deliverables, they are considered final.

Work in Progress: If you request a refund for work in progress, we will assess the amount of work completed and may provide a partial refund for work not yet delivered, minus any costs incurred and a reasonable cancellation fee as specified in your agreement.

Major Failures: If there is a major failure to meet Australian Consumer Law guarantees, you may be entitled to a full refund or compensation, regardless of project stage.

Deposits: Deposits paid at the commencement of a project are generally non-refundable unless there is a major failure or breach of contract on our part, as they secure our time and commitment to your project.

If you have concerns about your project, please contact us promptly so we can address them during the project timeline, before work is completed.

Cancellation Policy

Project cancellations are handled according to the terms specified in your project agreement. If you need to cancel a project, please contact us in writing to discuss the situation.

Client-Initiated Cancellation: If you choose to cancel a project:

  • You will be responsible for payment for all work completed up to the cancellation date
  • A cancellation fee may apply as specified in your agreement
  • You will receive all work completed up to the cancellation date
  • Any deposits paid may be non-refundable depending on the stage of the project

Service Provider-Initiated Cancellation: We reserve the right to cancel a project if:

  • You fail to make required payments
  • You breach the terms of the project agreement
  • We are unable to continue due to circumstances beyond our control

In such cases, you will receive all completed work and may be entitled to a refund for work not yet delivered, subject to the terms of your agreement.

Dispute Resolution

If you have a complaint or dispute regarding our services, we encourage you to contact us directly to discuss the matter. We are committed to resolving issues fairly and promptly.

If we cannot resolve a dispute directly, you may:

  • Contact the Australian Competition and Consumer Commission (ACCC)
  • Seek assistance from your state or territory consumer protection agency
  • Engage in alternative dispute resolution processes
  • Pursue legal remedies as available under Australian Consumer Law

Time Limits

If you believe you are entitled to a refund or other remedy, please contact us promptly. Delays in reporting issues may affect your ability to claim certain remedies.

Under Australian Consumer Law, you generally have a reasonable time to discover and report major failures, but it is best to raise concerns promptly.
